I. Call to Order: 4:01 P.M.
Four of five Planning Board members are present at today’s meeting which represents a quorum.
II. Review / Approval April 25, 2011 Planning Board Meeting Minutes
Bruce Komusin moves to accept the April 25, 2011 Planning Board meeting minutes as written. Mike Westphal seconds the motion. (4-0) Motion passes.
III. Review Application

Business District

Install a Rip Rap bank to extend the existing seawall
Ben Moore and Chris Moore are at today’s meeting to represent The Three Nephews, LLC. Ben Moore reports that in 1998 118 feet of rip rap was done on the property. During 2007 a storm damaged the existing seawall which was repaired. No work is expected to be needed on Lot 14 for the existing wall, unless it needs touching up which will be done if necessary. Approximately 60 feet will be added to the existing wall on Lot 13. There is no structure on Lot 13. The addition to the seawall will be the same height as the existing wall with round rock on top and fabric behind the wall. Materials used will be coming in by water at high tide. The Chairman of the Planning Board has spoken with John Cullen of the Department of Environmental Protection who states that the Permit by Rule for this project has been approved by DEP and will be forwarded to the Town Office and the Code Enforcement Officer. The Deputy Clerk has also contacted John Cullen of the DEP on May 03, 2011 who has promised to forward the permit by rule.

The only condition of this approval would be the written copy of the Permit by Rule from the Department of Environmental Protection.
IV. Other Business
• It is reported that Marvin Ott has had rip rap stones dumped at his property and has others stored at another property for a stabilization project. On March 03, 2009, the Planning Board denied the application for Marvin Ott, Tax Map 14, Lot 34, GCI for a permit after the fact for emergency installation of rip rap along the shore of their property. The permit was denied based on lack of information:
-land use standard, erosion and sedimentation control
-land use standard, storm water runoff - -land use standard, archeological sites
-and the condition of obtaining all other applicable permits
No further submittal of the required information has been received from the property owner. Selectman Beal will contact the Code Enforcement Officer in regard to this issue.
