Harbor Committee Meeting

I. Call to order: 6:05 P.M. by Chairman Bill Dowling.
Jim Fortune, Harbor Committee Alternate, will vote at today’s meeting in the absence of a quorum.
II. Review / Approval of May 26, 2011 Meeting Minutes
Richard Howland moves to accept the May 26, 2011 Harbor Committee meeting minutes as written. Jim Fortune seconds the motion. (3-0) Motion passes.
III. Review / Approval of Proposed Amendments to the Harbor Management Ordinance
For next year’s parking letters, the Harbor Committee recommends that the Manset boat stickers be numbered for identification of sticker owner, and that the stickers be only sold to residents as defined in the Harbor Management Ordinance, Section 9.2 Definitions: Any person who owns property in the Town Of Cranberry Isles, or any person who rents property with their boat registered in town and the excise tax paid in town.
In reference to commercial operators and contractors using our Manset Dock, Richard Howland suggests that a list of approved commercial operators / contractors list be written by the Board of Selectmen.

The Harbor Committee wishes to recommend the following change to the Harbor Management Ordinance, Section 4.1.3 Compliance with Maine Boating Laws:
Change: All vessels operating within the Town waters or using any property, equipment, or mooring managed by the Town of Cranberry Isles will comply with Title 12 M.R.S.A.

The Harbor Committee wishes to recommend the following change to the Harbor Management Ordinance, Section 4.2 Boat Owner or Operator:
Change: Any person using the facilities or moorings within the limits covered by this ordinance shall assume all risk of damage or loss to their person or property. The Town of Cranberry Isles assumes no risk of liability on account of fire, theft, Act of God, or damage of any kind to vessels within the above stated geographic limits, or at any property or mooring managed by the Town Of Cranberry Isles.

In reference to moorings, the Harbor Committee wishes to recommend the following change to the Harbor Management Ordinance, Section 6.7 General Mooring Provisions:
Add: Subsection F) “Town owned guest moorings within Town waters of Cranberry Isles and at the Town’s Manset Facility in Southwest Harbor, Maine, shall be limited to two consecutive nights. Harbor Master(s) or the Dockmaster may extend time limits on a case by case basis.”

The Harbor Committee recommends the following two changes to the Harbor Management Ordinance, Section 4.4.3 Obstruction of Manset Floats:
Change: The sides of the front two floats are limited to 6-hour tie up.
Delete: Because the Manset Dock is a new facility, the Harbor Committee will have jurisdiction over implementing additional policies as deemed necessary.
The Harbor Committee is an advisory committee to the Board of Selectmen and registered voters of the Town Of Cranberry Isles.
Change: The two inside floats shall be limited to 12 hour tie up and boats must be less than twenty feet in length.
(This sentence of section 4.4.3 currently reads: “The inside two floats shall be designated as bow tie up only, for a period 12 hours and boats must be less than twenty feet in length.” The Harbor Committee wishes to delete the part of the sentence “designated as bow tie up only, for a period”
Add: “Harbor Master(s) or the Dockmaster may extend time limits on a case by case basis.”

Typographical errors:

Section 4.4.2 Skiff Floats:
Change: lower case h to upper case H for Harbor (last sentence)
Change: lower case c to upper case C for Committee (last sentence)

Section 4.7 Water-Skiing:
Change: numbering sequence to 4.6 Water-Skiing (there is currently no section 4.6 in the Harbor Management Ordinance; this is a number sequence correction).

Section 4.8 Disposal of Waste and Refuse:
Change: numbering sequence to 4.7 Disposal of Waste and Refuse (there is currently no section 4.6 in the Harbor Management Ordinance; this is a number sequence correction).

Section 5.4 Personal Property:
Change: upper case P to lower case p for person (first sentence)

Section 6.3.1 Placement of New Moored Floats or Lobster Cars:
Change: change lower case h to upper case H for Harbor Master
Add: (s) to Harbor Master [Harbor Master(s)]

Section 6.4.3 Inspection Qualifications and Reporting:
Change: lower case t to upper case T for Town (last sentence).
Change: lower case o to upper case O for Office (last sentence).

Section 6.5 Mooring Inventory and Safety:
Change: lower case h to upper case H for Harbor (first sentence)
Change: lower case m to upper case M for Master (first sentence).
Add: (s) to Harbor Master [Harbor Master(s), first sentence]
Change: lower case m to upper case M for Master(s) (last sentence)

Section 6.6 Mooring Identification:
Add: ; (semi-colon) after when so directed by the Harbor Master(s); (last sentence).

Section 7.3 Violations:
Add: . (period) after $200.00. (last sentence).

Section 8.1.1 Enforcement:
Delete: , (comma) after If the Harbor Master(s) shall find that… (second sentence).

Richard Howland moves to approve the recommendations to the Harbor Management Ordinance. Bill Dowling seconds the motion. (3-0) Motion passes.

IV. Dock Updates
Bill Dowling moves to table Dock Updates until a subsequent meeting. Richard Howland seconds the motion. (3-0) Motion passes.

V. Other Business
• There are currently some lighting issues at Sutton Island Dock and Great Cranberry Island Dock. The Administrative Assistant is currently working with the electricians on this matter.
• Chalmers will build four egress ladders for Manset Floats.
• Dennis Dever has suggested that a bulletin board would be useful for the Manset Facility to keep posters all in one neat place.
Bill Dowling moves to recommend that Dennis Dever construct a bulletin board for inside the waiting area and outside the office at Manset. Richard Howland seconds the motion. (3-0) Motion passes.
